,,Dear Sir,
I refer to your email of 10 December 2010 addressed to the Commissioner for Taxation
and Customs Union, Mr Kovács, whereby you enquire about the developments in the
infringement case 2002/2009, which concerns certain provisions of the Romanian
legislation on pollution tax charged on passenger cars.
Following certain amendments of the Romanian legislation on the car pollution tax, the
Commission services examined their conformity with the EU law. It was concluded that
the national legislation, which exempted new and slightly used cars and heavily taxed all
other used cars, was hardly compatible with Article 110 of the Treaty on the Functioning
of the European Union (TFEU)1 as it seemed to discriminate certain used motor vehicles,
which came from other Member States. The Commission, therefore, by issuing a letter of
formal notice opened an infringement procedure against Romania on 26 of July 2009
(réf.: 2009/2002) requesting to change the contested rales (please, see a press release
attached hereto IP/09/1012).
The Romanian authorities replied with a letter of 28 September 2009 expressing their
position on this matter. Furthermore, on 12 of January 2010 the Romanian authorities
communicated the Government Emergency Ordinance 117/2009, which abolishes
exemption granted to certain cars under the Emergency Ordinance 218/2008 thus
reinstating taxation regime, which existed under the Emergency Ordinance 50/2008.
Consequently, the grounds for the infringement procedure at issue have been removed
and I will propose this procedure to be closed.
I take this opportunity to recall that there is no harmonization at the European Union
level in the field of passenger car related taxes. This means that indeed Member States
may impose such taxes and unilaterally decide upon their level and method of
calculation. Thus, Romania may keep the car pollution tax (which the Court of Justice
qualifies as an internal tax and not as an export/import duty2) and set its levels as high as

it sees fit (in Denmark, for example, a similar tax amounts to 180% of a vehicle&#039;s value).
In other words, there is no EU rule, which would require Romania to eliminate taxes
levied on new or used motor vehicles or would regulate their level3.
I would also like to inform you that the Commission being aware and concerned of the
difficulties that the European citizens face in connection with the car registration taxes
levied in different EU Member States on 5 July 2005 presented a proposal for a Directive
which, inter alia, includes elimination of the car registration taxes as from 1 January
2016. Moreover, the proposal includes provisions establishing a refund system for
registration taxes to be applied on those passenger cars which have been registered in a
Member State and are subsequently exported or permanently transferred to another
Member State. The objective of this measure is twofold: first to avoid double payment of
registration taxes, and second to charge registration taxes according to the use of the car
in the Member State concerned. Although the adoption of the EU legislation in the field
of taxation requires unanimity in the Council the Commission remains hopeful that the
Member States would be cooperative in removing the remaining tax obstacles in the
Internal Market4.

		<description>Multumesc pentru raspuns. Am citit de mult toate articolele despre adusul masinilor din Germania si cand voi face rost de toti banii cred ca voi pleca spre parcul lor. E adevarat ca masinile sunt mai scumpe si cu siguranta in Romania se gasesc altele mult, mult mai ieftine, insa am luat o data de la samsar masina din Franta(il si cunosteam pe respectivul)si nu mai imi trebuie(am bagat multi in reparatii). As vrea o masina fara probleme. Ms inca o data de raspuns. Numai bine !</description>
